Appeal of revocation of firearms licence — domestic violence — "fit and proper person" test — Arms Act 1983, s 24. The appellant appealed a determination by police to revoke his firearms licence on the basis he was not a "fit and proper person" under s 24(1)(b) of the Arms Act. The basis for the revocation were three instances of domestic violence and a warning letter regarding his status as a fit and proper person. The appellant was a professional hunting guide and required firearms as part of his job. The Judge considered the three instances of family violence, the seriousness of the incidents, and the five character witnesses provided by the appellant. The Judge granted the appeal, finding the appellant was a "fit and proper person". In reaching the decision, the Judge noted the appellant's long and excellent record with firearms, the low level of the family violence, the appellant's attendance at counselling and his personal circumstances, both past and present.
