Sentencing — wounding with intent to cause grievous bodily harm — domestic violence — R v Taueki [2005] 3 NZLR 372 — Crimes Act 1961, s 188(1) — Sentencing Act 2002, ss 7, 8. The defendant appeared for sentence on a charge of wounding with intent to cause grievous bodily harm. After arguing with his wife, he entered the bedroom and struck her twice with a large knife, seriously injuring both of her arms. The Court found that the aggravating features of the offending were a degree of premeditation, breach of trust, a vulnerable victim (she was in bed when the attack started), use of a weapon, and extreme violence. The offending fell within band 2 of R v Taueki, and the Court reached a starting point of eight years six months. The Court applied discounts for the defendant's largely good previous character, his health problems, his attempts at rehabilitation, his remorse and guilty pleas. The final sentence was four years and seven months' imprisonment.
