Sentencing — wounding with intent to cause grievous bodily harm — gang violence — R v Taueki [2005] 3 NZLR 372. The defendant appeared for sentence on one charge of wounding with intent to cause grievous bodily harm. He had been travelling in a truck with five others when he had spotted the victim, who was a member of a rival gang. The defendant attacked the victim's vehicle with an axe and struck the victim in the leg, causing a deep gash. Aggravating features of the offending were: that it was part of the gang violence that had plagued Rotorua for several years; use of a weapon; and serious injury to the victim. The Court assessed the offending as falling into band 2 of Taueki, and set a start point of seven years. With discounts for guilty plea and prospects of rehabilitation, the final sentence was five years three months imprisonment.
