Sentencing — aggravated robbery — theft of vehicle — R v Mako [2000] 2 NZLR 130. The defendant appeared for sentence on one charge of aggravated robbery. The defendant, along with three others, drove to a service station in a stolen vehicle and robbed the store, armed with hammer and wearing disguises. The offenders escaped with cigarettes, cash and caused damage totalling approximately $5500. The Judge fixed the starting point for the offending at five years and uplifted six months for the defendant's extensive criminal history. The Judge granted an eight month reduction for the defendant's youth, having just turned 18, and a 25 percent discount for an early plea. That brought the sentence to three years and eight months, however, the defendant already faced a current sentence that would mean his end sentence would total six years eight months. The Judge, taking into account totality principles, reduced the sentence to three years, cumulative to his current sentence. Judgment Date: 20 April 2019.
