Sentencing — importing methamphetamine — manufacturing methamphetamine — supplying methamphetamine — R v Fatu [2006] 2 NZLR 72. The defendant appeared for sentence on three charges of importing methamphetamine, one of manufacturing methamphetamine, and one of supplying methamphetamine. He had imported 533 grams of methamphetamine via posted packages and had supplied an unknown quantity of methamphetamine from another importation. He had also, unsuccessfully, attempted to purify a batch of methamphetamine. The Court found that the offending fell into the top of band 3 or bottom of band 4 of R v Fatu. Given the scale of the damage to the community caused by methamphetamine, and the defendant's history of manufacturing it, this meant a start point of 13 years' imprisonment. The Court applied various discounts including for guilty plea, resulting in a final sentence of six years six months' imprisonment. The Court declined to set a minimum period of imprisonment, preferring to leave the matter to the parole board. Judgment Date: 28 September 2018.
