Child support — departure from formula assessment of child support — whether weekly payments made prior to a formula assessment were child support payments — Child Support Act 1991, s 104. A departure order from the formula assessment was made as ground 9 was satisfied. That is that previous payments, double the amount ofthe assessable rate determined by the Commissioner of Inland Revenue, were found to have been made for the benefit of the child.
