The orders sought were not appropriate because: - There was a lack of clarity about the funds available, and no independent information available to the Court; - The proposed rate of payment over time would significantly reduce the value of the compensation paid; and - The orders sought would circumvent the powers of the Official Assignee should the bankruptcy process be initiated.
