Dispute over guardianship matters — guardianship direction — Care of Children Act 2004, ss 4,5, 6 and 46R. The parties sought s 46R directions for guardianship matters (immunisation and schooling) when they could not agree. Under s 46R the Court has power to make a guardianship order that it thinks proper having regard to ss 4–6 of COCA. The Judge ordered that the eldest child would go to the school of her and her father's choice having regard to her views along with other considerations about the school. The Judge also directed that the children would be immunised in accordance with the Ministry of Heath guidelines, particularly given that there was a possibility they would be prevented from attending school if this didn't occur. Judgment Date: 21 July 2016. * * * Note: Names have been changed to comply with legal requirements * * *
