Costs — whether calderbank offer should be considered — District Court Rules 2014, rr 14.2 to 14.11. In circumstances where there was never an entitlement to the amount of loss claimed by the plaintiff, the court awarded costs against a third party claim, interest, half of the claimed costs against the defendant, and half of the claimed disbursements to the plaintiff. The court took into consideration the defendant's reasonable measure of success, and the plaintiff's reasonable and flexible engagement in negotiations. Judgment Date: 18 January 2017.
