R v Wallis [2018] NZDC 1487

Kidnapping — injuring with intent to cause grievous bodily harm — male assaults female — domestic violence — sentencing. The defendant was sentenced on kidnapping and domestic violence charges in relation to offending against his partner. The defendant and the victim engaged in consensual intercourse and, immediately afterwards, he accused her of having an affair. The defendant inspected the victim and upon discovering a substance that he believed confirmed the affair, he forced the victim to remove all of her clothing, tied her to a chair with a variety of cords, and preventing her from calling for help by tying socks around her mouth. Once she was bound, the defendant locked the door and beat her with a metal crutch. The defendant also pressed a lit cigarette against her upper thighs in five places. On a second occasion, the defendant demanded that the victim remove her clothing and "get out", the defendant grabbed her by the hair and pushed her into a bedroom, the victim was also hit to the face and back. The victim received extensive injuries. The defendant was given a discount for previous good character and guilty plea. The defendant was sentenced to a total period of imprisonment of three years and four months. Judgment Date: 30 January 2018.
