R v Day [2018] NZDC 5817

Published 08 April 2019

Sentencing — domestic violence — injuring with intent to cause grievous bodily harm — GBH — minimum parole period. The defendant appeared for sentencing on a range of domestic violence related charges, including charges of injuring with intent to cause grievous bodily harm, assault with a weapon, injuring with intent to injure, threatening to kill, and unlawful possession of a firearm . The Judge had previously given a sentencing indication of five years, which would be additional to the two years six months the defendant was already serving for related offending. The Judge made a reduction of three months for the defendant's view to enroll in a residential rehabilitation programme once on parole but did impose a 50 percent minimum parole period, due to the defendant's level of culpability, extreme violence, multiple vulnerable victims and the serious consequences of the defendant's offending. On the lead charge of injuring with intent to cause grievous bodily harm, the defendant was sentenced to four years and nine months. All remaining charges were sentenced concurrently.
