R v GT [2018] NZYC 329

Sentencing — S D — R v Mako — s 283 Oranga Tamariki Act 1989. A 17 year old, GT, appeared for disposition in the Youth Court on a charge of aggravated robbery. GT and another entered a store, pointed a sawn off slug-gun at the owner, loaded cigarettes and tobacco into their bags and left the store, pointing the slug-gun at a member of public in their escape. The Crown initially sought a transfer to the District Court. This was reduced to supervision and residence, but in consideration of GT's circumstances the Crown elected to support a supervision sentence and GT remaining on electronically monitored bail. The Judge referred to GT's childhood which involved exposure to violence, gangs and drug use from an early age. The victim of the crime wanted GT to be able to move on with his life and make something of himself. Following the crime, GT moved in with his brother and had demonstrated remarkable improvement in his behaviour. He admitted his wrongdoing immediately, expressed remorse, committed to being mentored and started attending a forestry course. The Judge referred to jail as a breeding ground for gang members and future criminals, particularly for young men, and made an order under s 283(k) of the Oranga Tamarki Act 1989 placing GT under the supervision of the Chief Executive for 6 months.
