Sentencing — posting a digital communication — Facebook — breach protection order — sending unwanted texts — following and confronting victim — male assaults female — attempting to pervert the course of justice — defendant instructing others to lie on his behalf — Horridge v Police [2018] NZHC 2589. The defendant appeared for sentence for a range of offences against his ex-partner. He had made a derogatory Facebook posting about her, which included personal details that could have placed her at risk. He also committed several breaches of her protection order against him, including following and confronting her, sending her unwanted texts and going to her house and assaulting her. He then convinced two other people to give him a false alibi for the offending. The Court described the offending as manipulative and commented that the defendant had not taken responsibility for his conduct. The Court set a total starting point of 29 months' imprisonment, with a six-month uplift for the aggravating features of offending while on bail plus previous convictions. The Court allowed a nine-month discount for guilty plea, for a final sentence of two years two months.
