Contempt of court — wilfully and without lawful excuse disobeyed a direction of the Court — refusal to purge contempt — apology — imprisonment — District Courts Act 2016, s 212 — Tamihere v Police [2016] NZHC 539 — Mair v District Court at Whanganui [1996] 1 NZLR 556 — Greer v Police High Court Palmerston North AP53/97, 17 October 1997. The defendant was found in contempt of court after refusing to follow directions given by the Judge. The defendant was given advice by the duty solicitor on how to lessen the penalty the contempt (an apology) but refused to do so, instead responding arrogantly to the opportunities given to him. The Judge referred to case law which confirmed the defendant's actions amounted to contempt of court. A sentence of ten days' imprisonment was imposed. Judgment Date: 15 August 2018.
