Sentencing — aggravated robbery — dairy robbery — R v Mako [2000] 2 NZLR 170. The defendant appeared for sentence having pleaded guilty to two charges; aggravated robbery and theft. The defendant and his co-offender entered a dairy with his face concealed and a sharp weapon. The co-offender had a hammer. The owners and a customer were inside and locked themselves in a room while the defendant made off with approximately $650 in cash and $2000 in cigarettes, tobacco and confectionery. The Judge, applying R v Mako, adopted a starting point of four and a half years but uplifted three months for his personal aggravating factors, including previous convictions. The Judge granted discounts of 15 per cent for the defendant's letter of remorse and guilty plea, albeit late, bringing the end sentence to three years and ten months' imprisonment.
