Sentencing — carrying on the business of motor vehicle trading without being registered to do so — selling 12 motor vehicles — Motor Vehicle Sales Act 2003. The defendant appeared for sentence on a charge of carrying on the business of motor vehicle trading without being registered to do so. She had sold 12 motor vehicles over the course of a calendar year, although she had received warnings from the prosecutor not to do so. The defendant explained that in fact another person had sold the vehicles using her name. Nevertheless, the Court observed that a penalty was required to send the message that the legislation was in place to protect consumers and reduce the number of unsafe vehicles on the road. The start point for fine was $8000, reduced to $3000 in light of the defendant's cooperation with the investigation, early plea and personal circumstances. The Court also added costs of $500. Judgment Date: 11 February 2020.
