Appeal from decision of Tenancy Tribunal — eviction of squatters — Residential Tenancies Act 1986, ss 65, 85 and 117 — Ziki Investments (Properties) Limited v McDonald [2008] 3 NZLR 417, 431. A s 117 appeal from the Tenancy Tribunal was allowed and the order of the Tribunal annulled. As the respondent was occupying the premises as a squatter, s 65 of the Act applied and the appellant was entitled to possession. Section 85 did not provide for the Tribunal to exercise its jurisdiction in the manner which occurred ("Ziki"). Judgment Date: 30 September 2016.
