Appeal against decision of NZTA — Land Transport Act 1998, s 106. An appeal under s 106 from a decision that the appellant was not a fit and proper person to hold a driving instructor endorsement was dismissed. The NZTA had made the correct decision, as allowing the appellant to hold a driving instructor endorsement would not be in the interests of public safety. The Judge came to this conclusion having considered factors set out in case law and legislation, which included the appellant's history of traffic and criminal offending. Judgment Date: 30 September 2016.
