Appeal from decision of Building Practitioners Board — Building Act 2004. The appeal was allowed regarding penalty as it was found that the Board had erred in law by taking into consideration inadmissible material. In light of that failing, although the findings that the appellant had acted in a negligent manner and brought the Licensed Building Practitioners regime in to disrepute, the penalty imposed was substituted with a sentence of 5 months' suspension of licence. Costs would remain as determined by the Board. Judgment Date: 3 November 2016.
