Children, Young Persons, and Their Families Act 1989, s 238 — Bail Act s 30. The young person was further remanded under s 238 following what the Judge described partly as a “legislative impasse”, between the CYPF Act Schedule 1 Amendments (s 30(1A)) and the Bail Act. An issue had arisen that the young person was expected to be present at Court for multiple purposes but was excused from attending as a Family Group Conference had not been completed in time. As a result, the young person was not able to update his lawyer with instructions about new charges impeding court processes. The Judge proposed that a solution would be to move young people held in remand in this situation closer to the Court in which they would appear.
