Unlawful arrest — Children, Young Persons, and Their Families Act 1989, ss 214 and 245. The young person’s arrest without warrant was found to be unlawful as it did not meet the grounds of s 214. Accordingly the charging documents before the Court were nullities, but the police were not precluded from bringing the proceedings through the alternative procedure under s 245.
