Costs — appeal from tribunal — Unit Titles Act 2010, s 131 — Residential Tenancies Act 1986, ss 102 & 117(7) — District Court Rules 2014, schs 4 & 5. The respondent sought costs from the appellant. The Judge had dismissed the appeal, with one issue remaining to be determined by way of rehearing in the Tenancy Tribunal. The costs calculated were for commencement of response to appeal; case management; preparation of written submissions; and appearance at hearing. The respondent also sought costs for preparation of case on appeal, but the Judge deemed this unnecessary. Additionally, the respondent sought costs incurred before the Tenancy Tribunal, but the Judge declined to do so as it was for the Tribunal to use its discretion to decide on an appropriate award of costs. The Judge directed that the appellant pay the respondent costs of $4545. Judgment Date: 29 July 2020.
