Under s 217 of the District Court Act 2016, the Chief District Court Judge must, in consultation with the
Chief Justice, develop and publish guidelines to assist Judges to decide if they should recuse themselves
from a proceeding.
The guidelines are for the assistance of all judicial officers of the District Court, as appropriate, including
Family Court Associates, Community Magistrates, Justices of the Peace and Disputes Referees.
These guidelines are issued after consultation with the Chief Justice and replace
those previously published.
